1. Preamble and definitions
1.1 About the publisher
RaceUp is an online ticketing platform dedicated to sports events, published and operated by:

1.2 Purpose of these Terms
These Terms and Conditions of Sale (hereinafter the "Terms") define the rights and obligations of the parties in connection with the sale of tickets for sports events via the RaceUp Platform.
These Terms govern exclusively the relationship between RaceUp and Participants. The relationship between RaceUp and Organizers is governed by the Organizer Terms of Use.
1.3 Definitions
The terms defined below have the following meaning:
- Platform or RaceUp: the online ticketing platform available at https://raceup.org and its subdomains
- Publisher: Timothy ALCAIDE, sole operator of the Platform
- Organizer: any natural or legal person who has entered into a contract with RaceUp to sell tickets for an Event via the Platform. The Organizer is solely responsible for organizing the Event
- Participant or Customer: any natural person who buys a ticket for an Event via the Platform
- Event: any sports event (road running, trail running, triathlon, cycling, swimming, etc.) organized by an Organizer whose registrations are managed via the Platform
- Ticket or Registration: personal entry pass to an Event bought by the Participant via the Platform
- Service fee: commission charged by RaceUp on each transaction and paid by the Participant
- Terms: these Terms and Conditions of Sale applicable to Participants
1.4 Acceptance of the Terms
Buying a Ticket on the Platform implies full, complete and unreserved acceptance of these Terms.
The Participant acknowledges having read the Terms before placing an order and expressly accepts them by ticking the box provided for this purpose.
The applicable Terms are those in force on the date the order is placed. They are available at any time on the Platform.
2. Nature of the service - Role as technical intermediary
2.1 RaceUp as an intermediary
RaceUp acts as a technical intermediary and as an agent on behalf of the Organizers.
RaceUp provides a technology platform enabling:
- Connecting Organizers and Participants
- Selling tickets for Events
- Secure payment processing via Stripe
- Passing registration data on to Organizers
- Sending registration confirmations to Participants
2.2 What RaceUp is not
ESSENTIAL CLAUSE: The Participant acknowledges and accepts that RaceUp is NOT the organizer of the Events offered on the Platform.
RaceUp:
- Does not organize and is not responsible for organizing sports Events
- Is not responsible for the holding, cancellation, postponement or modification of Events
- Is not responsible for the safety, supervision, emergency services or regulatory compliance of Events
- Is not responsible for the services promised by the Organizer (refreshments, medals, rankings, photos, etc.)
- Does not set and is not responsible for refund conditions, which are exclusively a matter for each Organizer
- Is not responsible for personal injury or property damage occurring during Events
- Is not responsible for the content published by Organizers on the Platform
By buying a Ticket, the Participant enters into a contract primarily with the Organizer of the Event concerned.
2.3 Verification of Organizers
RaceUp carries out reasonable checks on the identity of the Organizers registered on the Platform. However, RaceUp cannot guarantee the quality, reliability or solvency of Organizers and accepts no liability in this respect.
3. Registration and purchase conditions
3.1 Legal capacity
To buy a Ticket, the Participant must:
- Be of age (18 or over) or, if a minor, have the authorization of their legal representative
- Have the legal capacity to enter into contracts within the meaning of Articles 1145 et seq. of the French Civil Code
- Not be under guardianship without the guardian's authorization
3.2 User account
The Participant may create an account on the Platform to make registering easier. Creating an account implies:
- Providing accurate, complete and up-to-date information
- Keeping one's login details confidential
- Being responsible for any activity carried out from one's account
- Informing RaceUp immediately of any unauthorized use
The Participant is solely responsible for keeping their login details confidential.
3.3 Registering a minor
A minor must be registered for an Event by their legal representative (parent or guardian), who:
- Accepts these Terms in the name and on behalf of the minor
- Guarantees compliance with the Terms and the Event rules
- Provides, where applicable, the parental authorizations required by the Organizer
- Ensures that the minor is fit to take part in the Event
4. Ordering process
4.1 Information about Events
Information about Events (date, place, distance, route, prices, rules, cancellation conditions, etc.) is provided under the sole responsibility of the Organizers.
RaceUp does not check the content published by Organizers and cannot be held liable for any errors or omissions.
4.2 Information to be provided
The Participant must provide the information requested by the Organizer, in particular:
- Identification data: last name, first name, date of birth, gender
- Contact details: email, phone, postal address
- Specific information: shirt size, choice of race, club/team
- Required documents: medical certificate, sports licence, PPS (Health Prevention Pass)
- Emergency contact: name and phone number
The Participant guarantees that all the information provided is accurate and truthful. Any false declaration may result in the cancellation of the registration without refund and engage the Participant's liability.
4.3 Organizer's specific conditions
Each Organizer may set specific conditions for its Event:
- Medical and fitness conditions
- Minimum and/or maximum age
- Required level or qualifications
- Mandatory equipment
- Cancellation and refund conditions
- Bib transfer policy
The Participant undertakes to read and accept these specific conditions before confirming their registration.
The Organizer's specific conditions supplement these Terms. In the event of a conflict, the Organizer's specific conditions prevail for aspects specific to the Event.
4.4 Formation of the contract
The registration is final and the contract is formed after:
- Selecting the Event and the race
- Completing the registration form
- Accepting the Terms and the Organizer's specific conditions
- Paying the full amount due
- Payment confirmation by Stripe
A confirmation email is sent to the Participant once the order is validated. This email constitutes proof of registration.
5. Price and payment
5.1 Price breakdown
The total price paid by the Participant includes:
- The ticket price: price freely set by the Organizer for access to the Event
- The RaceUp service fee: variable commission charged by RaceUp for the use of the Platform
- Transaction fees: bank fees applied by Stripe
All prices are displayed in euros (€), all taxes included.
The price breakdown (ticket price, service fee, total amount) is clearly displayed before payment is confirmed.
5.2 RaceUp service fee
The service fee is RaceUp's remuneration for providing the Platform. This fee:
- Is paid exclusively by the Participant
- Is clearly indicated before payment is confirmed
- May vary depending on the Events and the agreements with Organizers
- Is non-refundable (unless required by law)
5.3 Secure payment
Payment is made online via Stripe, an authorized payment service provider certified PCI-DSS Level 1.
Accepted payment methods:
- Bank cards: Visa, Mastercard, American Express, Cartes Bancaires (CB)
- Other methods available via Stripe depending on the country
5.4 Transaction security - Stripe Connect
Payments are processed via Stripe Connect, which means that:
- Funds are paid directly to the Organizer (after deduction of Stripe fees)
- RaceUp receives its commission via Stripe Connect
- RaceUp does not store any bank card data
- All transactions are secure and comply with PCI-DSS standards
Stripe is solely responsible for processing bank data.
5.5 Confirmation and invoice
Once payment is validated:
- The Participant receives a confirmation email with their electronic ticket
- A detailed invoice is sent by email
- The Organizer is notified of the registration
The invoice shows the ticket price, the service fee and the total amount including taxes.
6. Right of withdrawal
6.1 Exclusion of the right of withdrawal
In accordance with Article L. 221-28, 12° of the French Consumer Code, the 14-day right of withdrawal does not apply to contracts for leisure services that must be provided on a specific date.
Tickets for sports Events on a fixed date fall into this category and do not benefit from the right of withdrawal.
6.2 Information to the Participant
By confirming their order, the Participant expressly acknowledges:
- Having been informed of the exclusion of the right of withdrawal
- That this exclusion results from the nature of the service (event on a specific date)
- That their order is firm and final
6.3 Organizer's policy
Regardless of the legal exclusion of the right of withdrawal, each Organizer may set its own cancellation and refund policy.
The Participant must consult the Organizer's conditions before finalizing their order.
7. Cancellation and refunds
7.1 Exclusive competence of the Organizer
The Organizer alone decides whether to accept or refuse a refund request.
RaceUp is not involved in this decision and does not make refunds on behalf of Organizers, except in the cases provided for in Article 7.4.
7.2 Refund requests
For any refund or cancellation request, the Participant must contact the Organizer directly as indicated on the Event page.
RaceUp does not handle refund requests relating to Events.
7.3 Refund terms
If a refund is granted by the Organizer:
Ticket price:
- The refund is made by the Organizer via Stripe
- The amount refunded and the timeframe depend on the Organizer's policy
RaceUp service fee:
- The RaceUp service fee is non-refundable, except in the case of:
- Cancellation of the Event by the Organizer without postponement
- A legal obligation
- An exceptional decision by RaceUp
Stripe bank fees:
- Stripe fees are generally not recoverable and may be deducted from the refund
7.4 Cancellation of the Event
If the Event is permanently cancelled by the Organizer (without postponement):
- The Organizer is solely responsible for informing Participants
- The Organizer is solely responsible for making refunds in accordance with its policy
- RaceUp may facilitate communication but is not responsible for refunds
- The RaceUp service fee will be refunded only if the Event is permanently cancelled with no alternative offered
7.5 Postponement of the Event
If the Event is postponed:
- The ticket remains valid for the new date, unless the Organizer states otherwise
- Refund conditions are set by the Organizer
- RaceUp is not responsible for refunds related to the postponement
7.6 Force majeure
In the event of force majeure (natural disaster, pandemic, administrative decision, extreme weather conditions, etc.):
- The Organizer decides how to handle the situation (postponement, cancellation, refund)
- RaceUp cannot be held liable and is not required to make refunds
- The Organizer's decisions are binding on Participants
8. Transfer and modification of registrations
8.1 Organizer's policy
Whether a registration can be transferred to a third party or modified (category, race, options) depends exclusively on each Organizer's policy.
8.2 Procedure
The Participant must contact the Organizer directly for any transfer or modification request.
Additional fees may be charged by the Organizer.
8.3 Bib exchange between members ("Race bibs" section)
The "Race bibs" section allows a member to offer a race bib they can no longer use and to be contacted by other members. This service is free of charge.
- RaceUp only puts members in touch. RaceUp does not sell the bibs offered, charges no commission, handles no payment and is not a party to the exchange agreed between members.
- RaceUp guarantees neither the validity of the bib nor its transfer. Whether a bib can be transferred depends exclusively on the Organizer's rules. Both the seller and the buyer are responsible for checking these conditions with the Organizer before agreeing, and for carrying out the name change according to the Organizer's procedure.
- Events whose registrations are sold through RaceUp ticketing are excluded from the section. For these Events, articles 8.1 and 8.2 apply.
- The member who publishes a listing guarantees that the information published is accurate and undertakes to keep it up to date (availability, sale, withdrawal). RaceUp may ask them to confirm that the bib is still available and pause the listing if they do not reply. Listings expire on the race date.
- Personal contact details (phone number, email, links, social media accounts, bank details) may not be published in listings or shared in the first exchange: members communicate through RaceUp messaging. Only a member's first name and last initial are visible to other members.
- RaceUp may hide or delete a listing, and suspend a member's access to the section, following a report, in case of misleading or inappropriate content, or in case of breach of these Terms.
RaceUp cannot be held liable in connection with a bib exchange between members, in particular if the Organizer refuses the transfer, in case of non-payment, if the bib is not handed over, or in case of a dispute between members.
9. Participant's obligations and liability
9.1 Participant's obligations
The Participant undertakes to:
- Provide accurate and complete information when registering
- Prove their medical fitness to take part (medical certificate, PPS, licence, as required by the Organizer)
- Comply with the Event rules and the Organizer's instructions
- Comply with safety instructions
- Take out appropriate insurance (personal accident insurance recommended)
- Present the required documents on the day of the Event
- Not hand over their bib without the Organizer's authorization
9.2 Participant's liability
The Participant is solely responsible for:
- The accuracy of the information provided
- Checking their fitness to take part
- Their own safety and behaviour during the Event
- The consequences of a false declaration
9.3 Sanctions
In the event of a false declaration, fraud or failure to comply with the rules:
- The registration may be cancelled without refund
- Access to the Event may be refused
- The Participant may incur civil and/or criminal liability
9.4 Prohibition of abusive chargebacks
The Participant formally undertakes not to initiate a payment dispute with their bank (chargeback) when they have:
- Actually taken part in the Event, or
- Been duly registered and the Event took place normally, or
- Obtained a refund from the Organizer
Any abusive dispute constitutes fraud that may result in:
- Civil and criminal proceedings
- A ban from the Platform
- Bank fees and penalties being passed on to the Participant
10. Limitation of RaceUp's liability
10.1 Exclusion of liability for Events
RaceUp, as a technical intermediary, excludes all liability regarding:
- The organization, holding, quality or safety of Events
- The cancellation, postponement or modification of Events
- Personal injury, property damage or non-material damage occurring during Events
- The Organizer's failure to meet its obligations
- The services promised by the Organizer
- Disputes between Participants and Organizers
- Organizers' refund policies
- Content published by Organizers
The Participant agrees that any claim relating to the Event shall be addressed exclusively to the Organizer.
10.2 Technical liability
RaceUp strives to ensure:
- The availability of the Platform 24/7
- The security of transactions
- The correct transmission of registration data
However, RaceUp does not guarantee permanent availability and cannot be held liable for:
- Temporary interruptions for maintenance or updates
- Malfunctions related to the internet or the Participant's equipment
10.3 Limitation of the amount
In any event, RaceUp's liability is limited:
- To direct and foreseeable damage
- To the amount of the service fee received by RaceUp for the transaction concerned
RaceUp cannot be held liable for indirect damage (loss of opportunity, non-material damage, travel costs, etc.).
11. Intellectual property
11.1 RaceUp's rights
The RaceUp Platform, its architecture, design, features, texts, graphics, logos, icons and software are the exclusive property of Timothy ALCAIDE.
Any unauthorized reproduction, modification or use is prohibited.
11.2 Organizers' content
Content published by Organizers (descriptions, logos, photos, routes) remains their property. RaceUp holds a licence to use it for the purposes of the Platform.
12. Personal data
12.1 Data controller
RaceUp, represented by Timothy ALCAIDE, is the controller of the data collected via the Platform.
12.2 Transmission to the Organizer
IMPORTANT: The Participant's registration data is passed on in full to the Organizer, who becomes the controller of this data for the organization of its Event.
The Participant expressly accepts this transmission by confirming their registration.

13. Complaints and mediation
13.1 RaceUp customer service
For any question about the Platform or the registration process:

13.2 Complaints about the Event
For any complaint about the Event itself, the Participant must contact the Organizer directly.
13.3 Mediation
In accordance with Articles L. 611-1 et seq. of the French Consumer Code, in the event of a dispute, the Participant may use mediation free of charge.

14. Governing law and jurisdiction
14.1 Governing law
These Terms are governed by French law.
14.2 Language
The French version of the Terms prevails over any translation.
14.3 Jurisdiction
In the event of a dispute and failing an amicable solution or mediation:
- For consumers: the courts of the Participant's place of residence or of RaceUp's registered office
- For professionals: the courts of Montpellier have exclusive jurisdiction
15. General provisions
15.1 Entire agreement
These Terms constitute the entire agreement between RaceUp and the Participant regarding the use of the Platform.
15.2 Partial invalidity
If a clause of the Terms is declared invalid, the other clauses remain in force.
15.3 No waiver
RaceUp's failure to invoke a clause does not constitute a waiver.
15.4 Changes to the Terms
RaceUp reserves the right to modify the Terms. The applicable Terms are those in force on the date of the order.
15.5 Assignment
RaceUp may assign these Terms to any third party, in particular in the event of a transfer of the Platform.
16. Beta status
The RaceUp Platform is in development (beta). The Participant is informed of this and accepts that:
- Changes and modifications may occur
- Technical malfunctions may occur
- Some features may be modified or removed
RaceUp undertakes to fix malfunctions as quickly as possible.
